Yard of Duty Terms & Conditions (Enhanced)

These Terms & Conditions ("Terms") govern your use of yardofduty.com and any services provided by Yard of Duty ("Yard of Duty," "we," "us," or "our"). By accessing our Site or booking services, you agree to these Terms.
1. Services and Service Area
Yard of Duty provides pet waste removal and related yard services, subject to service area coverage, staffing and scheduling availability, weather and safety conditions, and access to customer property.
We reserve the right to refuse, limit, suspend, or discontinue service at our discretion for safety, nonpayment, abusive conduct, repeated access failures, or other legitimate business reasons.
2. Quotes, Estimates, and Pricing Adjustments
Quotes and estimates are based on the information provided by the customer, including but not limited to property size, number of dogs/pets, cleanup frequency, waste accumulation level, accessibility, and special conditions.
If actual conditions differ materially from what was represented, we may adjust pricing and notify the customer before continuing service when reasonably possible.
3. Scheduling, Route Operations, and Arrival Windows
Service may be scheduled by route day and/or time window. Exact arrival times are not guaranteed unless explicitly agreed in writing. We may reschedule due to weather, safety issues, route changes, emergencies, vehicle problems, or other operational reasons.
4. Customer Property Access and Conditions
The customer is responsible for ensuring safe and lawful access to the property and service areas. The customer agrees to:
- Provide accurate access instructions
- Maintain accessible gates/entry points (unless otherwise arranged)
- Notify us of locked gates, pets, hazards, or special conditions
- Ensure service areas are reasonably safe
If access is not available or conditions are unsafe, we may skip or reschedule service and apply applicable fees.
5. Pets and Animal Behavior
The customer is responsible for disclosing known aggressive, reactive, or dangerous animal behavior. Yard of Duty may stop or refuse service if any pet presents a safety risk. We are not required to handle or restrain pets. The customer remains responsible for securing pets as needed to allow safe service.
6. Customer Communications (Call, Text, Email)
By providing contact information, the customer consents to receiving communications related to quotes, scheduling, service updates, billing, and customer support. Marketing messages will be sent only where legally permitted and/or with customer consent. Customers may opt out of marketing messages, but service-related communications may still be sent.
7. Photos and Videos (Service Documentation and Marketing)
A. Service Documentation
Yard of Duty may take photos/videos of service areas for legitimate business purposes, including documenting service completion, documenting access problems or unsafe conditions, resolving complaints/disputes, and internal training/quality control.
B. Marketing Use
We may use before/after photos or videos for marketing only if permitted by law and/or with customer consent.
8. Payments, Invoices, and Nonpayment
Customers agree to pay all charges for services, add-ons, fees, and applicable taxes, as invoiced or agreed. We may require payment before service, require a card on file for recurring service, charge approved recurring or auto-pay amounts, and pause or terminate service for unpaid balances.
Returned payments, failed payments, or chargebacks may result in delayed or canceled service.
9. Recurring Services and Auto-Renewal (If Offered)
If the customer enrolls in recurring service or membership:
- Service and billing may continue automatically until canceled
- Frequency, pricing, and terms will be disclosed at enrollment
- Route day/time may vary unless guaranteed in writing
- Skipped visits and last-minute cancellations may still be charged under our policy
10. Cancellations, Refunds, and Re-Service
Cancellations, rescheduling, refunds, credits, and re-service requests are governed by our Refund, Cancellation & Service Policy, which is incorporated into these Terms by reference.
11. Website Use Restrictions
You agree not to:
- Use the Site for illegal or fraudulent purposes
- Interfere with or disrupt Site operation or security
- Copy, scrape, or reuse Site content without permission
- Submit false, misleading, or abusive requests or communications
- Attempt unauthorized access to accounts, forms, or systems
12. Intellectual Property
All content on yardofduty.com, including text, logos, graphics, branding, and design elements, is owned by or licensed to Yard of Duty and may not be used without permission.
13. Disclaimer of Warranties
The Site and services are provided on an "as is" and "as available" basis to the extent permitted by law. Yard of Duty does not guarantee uninterrupted Site availability, error-free Site content, exact service timing, or outcomes affected by weather, access limitations, hidden waste, or unsafe conditions outside our control.
14. Limitation of Liability
To the fullest extent permitted by law, Yard of Duty will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or services. To the fullest extent permitted by law, Yard of Duty's total liability for any claim related to a specific service shall not exceed the amount paid for that specific service.
15. Indemnification
You agree to indemnify and hold harmless Yard of Duty from claims, damages, losses, and expenses arising from inaccurate information you provide, unsafe property conditions, aggressive or uncontrolled animals, your misuse of the Site, or your violation of these Terms.
16. Force Majeure / Events Beyond Our Control
Yard of Duty is not responsible for delay or nonperformance caused by events beyond our reasonable control, including severe weather, flooding, snow/ice, natural disasters, road closures, emergencies, equipment failure, illness, or governmental actions.
17. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute arising from these Terms or services shall be handled in a court of competent jurisdiction in New York, unless otherwise required by law.
18. Changes to Terms
We may revise these Terms at any time. Updated Terms will be posted on the Site with a revised "Last updated" date. Continued use of the Site or services after updates constitutes acceptance of the revised Terms.

Terms & Conditions - the basics
Having said that, Terms and Conditions (“T&C”) are a set of legally binding terms defined by you, as the owner of this website. The T&C set forth the legal boundaries governing the activities of the website visitors, or your customers, while they visit or engage with this website. The T&C are meant to establish the legal relationship between the site visitors and you as the website owner.
T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).
